Miss Brown was allergic to dairy products. If she came into contact with them and in particular if she ingested any dairy products then she would suffer an anaphylactic reaction.
She purchased a vegetarian burger from a well-known high street fast food outlet. There was no list of ingredients on display so she asked the employee serving her whether the burger contained any dairy products. He assured her that it did not but unfortunately he was wrong. Having decided to eat in she sat down and began to eat the burger but quickly felt her throat tightening and fell into anaphylactic shock.
Fortunately for her she was rushed to the local hospital where, with appropriate treatment, she recovered within a few hours.
She received £6,000.00 for the pain, suffering and loss of amenity caused by the anaphylactic reaction. The amount reflected the severity of the condition. It is potentially fatal if not treated appropriately and quickly. Furthermore each subsequent anaphylactic reaction tends to be more serious than the previous one so each has consequences for the future.
