Fleabite Claim

Miss B moved into Council rented accommodation. The property was in an appalling state and the Council agreed to clean it thoroughly before she took up residence. However it was either not cleaned or not cleaned properly so that when Miss B moved in it was infested with fleas. The Council knew that the client had nowhere else to stay, despite the appalling state of the property and did not fumigate, despite her requests, until several weeks later. They did not warn her about the state of the property and in particular about the flea infestation.

She suffered severe fleabites about her body but in particular to both arms and was left permanently scarred by these.

She recovered £5,000.00 being roughly £1,000.00 towards financial losses (a bed to replace the flea infested one, some fake tanning lotion to cover up the scars and some travel expenses) and £4,000.00 for the pain, suffering and loss of amenity as a result of the injuries.

It is an interesting case both in relation to the somewhat unusual circumstances and the fact that we were able to establish liability against the Landlord, who just happened to be the local Council.
