Use Solicitors For Injury Claims

The insurance industries attack on injured victims shows no signs of letting up. I hear that within months, a number of insurers will be running advertising campaigns encouraging Claimants not to get a solicitor, but instead to deal direct with the responsible party’s insurers.

In other words the insurer against whom you are claiming, want you to let them get a medical report, then tell you what your injuries are worth and what you can claim for financial losses. But valuing an injury, for example, is not an easy task. How many members of the public know how much their broken arm is worth? What difference does it make if it is the dominant rather than the non-dominant arm which is injured? What if the medical report says there is no risk of future arthritis at the break, yet the injured victim is not so sure? Can we trust insurers to deal with these issues in the Claimant’s interest? 

Alternatively is it more likely that the insurers will try and settle at low damages and in full and final settlement with no prospect of the Claimant being allowed to come back for more if they later discover the insurers have underpaid them. It is, I fear, statistically inevitable that a significant number of future Claimants are going to wish they had sought legal advice rather than dealing direct with insurers, but by the time they realise this it will be too late.

This so called “third party claim capture” is a scandal in which the Financial Services Authority shows virtually no interest. They think the insurance industry can be trusted to police the system themselves!
