How we do it

As debt recovery lawyers who are experts in what we do, we offer a high class and cost-efficient system for the recovery of money that is non-contested.  We understand business as well as the law and we aim to assist you by providing you with practical advice in plain English, which will offer you the maximum chance of making a recovery.

We are not a volume debt recovery agency manned by unskilled staff that spends all of the day on the telephone, attempting to secure recovery.  We are all skilled professionals who specialise in debt recovery.  We aim to be a seamless integration within your credit control/accounting function, that can be used for the collection of funds which are past your terms of trading.  We are not just a mechanism for the recovery of funds. We are also able to provide your business and your credit control staff with advice and consultancy on all aspects of credit control, debt recovery, foreign transactions, debtor bankruptcy or corporate insolvency.

We understand that your business needs cashflow to survive and that you may need to remind you clients when your invoices need paying, even though you need to retain them as clients.  We specialise in providing pragmatic advice and taking the correct action against the correct types of debtor. We know that preserving the relationship is often one of your biggest concerns and we are experienced in recovering your money whilst not jeopardising that relationship. But do not think we are pushovers, we are not.  We are firm and fair and we will take whatever action is necessary in order to recover your debt. 

Our whole fee structure largely depends upon us making a recovery for you as we work mainly on a no win, no fee basis so that our success lies in recovering money for you and not just taking money from you.

Stages we take in recovering the sums due to you

Where the debtor resides in England and Wales:

  • We normally start action against a debtor by sending them a Letter Before Action (LBA)
  • If this goes unanswered we then issue a Claim Form in the County Court
  • If no defence to the claim is received we then enter judgment (County Court Judgment or a CCJ)
  • We can then proceed with enforcement of the judgment.

Where the debtor resides outside of England and Wales but within the European Union:

  • We normally start action against a debtor by sending them a Letter before Action (LBA) which has been translated into their native language.
  • If this goes unanswered we then issue a Claim Form in the County Court seeking permission to serve the debtor outside of the jurisdiction. This is dependant upon any jurisdiction clauses in the terms agreed between the parties. Specialist advice should be sought from one of our international law experts. We also organise translations of the court papers so that the debtor is able to understand what is happening and also the debtor knows you are serious about recovering sums due to you. We can also arrange personal service of documents on the debtor overseas anywhere in the world. 
  • If no defence to the claim is received we then enter judgment (County Court Judgment or a CCJ
  • We can then proceed with enforcement of the judgment. At this point we instruct one of our network of international agents based in the debtor’s jurisdiction to register the judgment in that country and commence enforcement.

Where the debtor resides outside of the jurisdiction and outside of the European Union:

  • We normally start action against a debtor by sending them a Letter Before Action (LBA) which has been translated into their native language.
  • We recommend that you speak to us as different jurisdictional rules apply depending on the type of action, the amount, the locality of the debtor and the nature of the debt.
