Every country is different and therefore we suggest that you contact us to discuss your legal needs and requirements for a preliminary advice as to the merits of your claim. Difficulties arise not just because of language barriers but also because legal systems differ greatly. For example, the time limits for starting proceedings can vary from three months to thirty years depending upon the country and the nature of the claim. Choices need to be made as to whether to issue proceedings in the UK and enforce abroad, or take proceedings and enforce in the debtor's state. However, strategies need to be adopted to avoid, whenever possible, the need to issue proceedings at all. Pre-action correspondence in the debtor's own language massively increases effectiveness. The team has also put together a network of specialist agencies across Europe with whom they work to either directly recover from the debtor, or assist with proceedings. In most cases a suitable recovery programme can be found, including visits to the debtor.
European Based Recovery
Since the establishment of the EC many of the rules and regulations which have arisen to assist with the harmonisation of laws across Europe to ensure that the members states have no internal barriers. In 2001 Article 44/2001 was enacted in Europe to assist with the easy recognition and registration of judgments in different member states.
Registering English Judgment Abroad
Under Annex 5 of Article 44/2001 to court giving the judgment completes the certificate and seals it along with the judgment. If the recipient is not a native English speaker then certified copies of the translations are necessary. These documents can then be registered with an Apostille (depending upon whether the recipient country requires this). We then pass the bundle of certified documents to one of our local agents within that country who has a track record of success and recognised professional qualifications.
Registering Foreign Judgments Abroad
Another niche area of our practice is the registration and enforcement of foreign judgments here in the UK. Very few legal firms can state that they have experience of doing this. We are one of the few who frequently practice in this area.
