Planning Law

Ensuring that the property has lawful planning use and is in compliance with all relevant conditions is fundamental to development and occupation. We advise on interpretation of consents and whether a new permission is required. We also deal with applications for certificates of lawful use or proposed use and development and the negotiation of planning agreements and unilateral undertakings.

With the assistance of our Dispute Resolution team we have advised and handled applications for judicial review and planning appeals (whether by inquiry or written representation) including appeals against enforcement action and compulsory purchase . We can undertake representation at public enquires.

Planning law and the environment

Planning and environmental regulation changes regularly and often environmental law dovetails with planning issues. We can advise on land use, conservation and development plans as well as environmental issues arising in planning applications, such as advice on contamination and responsibility for clean up. With the assistance of our Dispute Resolution team we have advised on breaches of licences and prosecutions by regulatory authorities together with giving advice on taking or defending claims for nuisance negligence and breach of statutory duty .
