These days, in all areas of dispute, the Courts try to discourage parties from issuing Court proceedings. This means that where a dispute arises, the parties are expected to negotiate fully before resorting to Court proceedings.
The Association of Contentious Trusts and Probate Specialists (ACTAPS) has prepared a Protocol setting out the appropriate procedure which should be followed by people who have a dispute in this area of the law, before taking their dispute to the Courts.
ACTAPS is an association of lawyers, to be a member of this organisation denotes a badge of expertise, so that if you are dealing with a member of ACTAPS, you can be assured that you are dealing with someone who is an expert in this field of the law.
