Discrimination

There is no minimum period of employment to receive protection against discrimination and protection is provided to employees, the self employed, independent contractors and workers.

The broad categories of discrimination are:

  • Age Discrimination
  • Disability Discrimination
  • Race Discrimination
  • Religious Discrimination
  • Sex Discrimination
  • Sexual Orientation

Discrimination can be:

Direct Discrimination - which is when a person is treated less favourably on the grounds of a personal characteristic such as their age, a disability they have, their race or religion, or their gender or sexual orientation.

Indirect Discrimination - where an apparently neutral provision, criterion or practice would put people of one sex/race/religion etc at a particular disadvantage compared with persons of a different sex/race/religion etc. However, it is possible to objectively justify such a provision, criterion or practice if it can be shown to be a proportionate means of achieving a legitimate aim.

As well as discrimination, an employee may also experience:

Harassment - when an employee experiences behaviour which creates an “intimidating, hostile, degrading, humiliating or offensive (working) environment” for them.

Victimisation - when an employee is treated less favourably by their employer because they have asserted their rights under discrimination legislation.
