Unfair Dismissal

If you have 51 weeks or more continuous service with your employer and you are dismissed, you may wish to bring an Employment Tribunal claim for Unfair Dismissal.

In these circumstances, your employer may be ordered by the Employment Tribunal to pay you compensation, unless it can show:

  • it had a fair reason for the dismissal -  for example, misconduct or redundancy - and
  • that it has acted reasonably in dismissing for that reason.
