Accidents At Work

Accidents at work or work place accidents are too diverse for us to cover all possibilities, but the usual rules apply when considering a claim for compensation. 

If you have suffered injury in an accident at work which you believe to be at least partly someone else’s fault (or even a work colleague's fault) then provide us with:

• a detailed description of the accident,
• photographs,
• a sketch plan,
• and contact details for any witnesses.

We can then investigate the accident for you and let you know whether or not we think you may have a claim, either against your employer or perhaps someone else such as the site operator (if they are not also your employer).

You may be able to establish a claim either for breach of contract, breach of statute or for common law negligence, or possibly some combination of those three. Remember that you can only claim compensation if we can prove that someone else was at least partly to blame for your accident.

Evidence For An Accident Claim

Remember that you can only claim what you can prove, so the importance of a detailed description of the accident, a sketch plan, photographs, but most importantly independent witnesses cannot be stressed too highly.

Make sure that the accident details are reported and that an accurate description of the accident appears in the Employers' Report Book, preferably at the time the accident occurred.

Once fault has been established, the next step in your claim is to prove your injuries; which we achieve by obtaining a medical report and to establish your financial losses.
