Timescales for Professional Negligence Cases

  • Professional negligence cases are subject to time limits referred to as 'limitation periods'.
    The period during which a claim must be brought generally varies between one and six years.
    Professional advice should be taken as soon as you realise that you may have a claim.
  • Completing the pre-action protocol steps will, in all likelihood, take approximately 4 months.
  • If court proceedings are necessary and the case does not settle, there will usually be a period of 12 to 18 months between issuing the proceedings and the trial of the action.
