Notable cases:
- Kelly represented a client who sustained significant injuries following a slip in a large supermarket. The claim involved complex issues of liability, together with extensive expert medical evidence from orthopaedic, pain management and psychiatric specialists. Kelly managed the claim throughout the litigation process, including rehabilitation, disclosure, witness evidence, expert evidence, case management and settlement negotiations. The claim required careful consideration of chronic pain and ongoing functional limitations until a suitable settlement was reached before Trial.
- Kelly represented a child who sustained serious injuries during a school trampoline lesson. The claim involved complex issues of quantum and causation including future loss of earnings which required careful consideration of the long-term impact that the injuries had on his education and employment prospects. Kelly successfully progressed the claim by obtaining detailed witness and expert evidence and secured a substantial settlement for the client.
- Kelly acted for the family of a deceased individual in a clinical negligence claim arising from a failure to correctly interpret diagnostic imaging. The patient presented to their GP with ongoing gastrointestinal symptoms and was referred for further investigation. A CT scan was performed but was incorrectly reported as showing no significant abnormality. Subsequent investigation determined that the imaging in fact demonstrated signs of pelvic sepsis which were not identified by the reporting radiologist. As a result, the patient was not admitted for urgent treatment such as antibiotics or surgery. The individual later tragically died from sepsis. The healthcare provider admitted breach of duty and causation, acknowledging that the CT scan was misinterpreted and that appropriate follow-up treatment would likely have been initiated had the findings been correctly reported. A substantial settlement was reached for the family.
- Kelly acted for a client who suffered a broken wrist after falling when a handrail failed. During the course of the claim, it became apparent that the company responsible for the premises had been dissolved. Kelly successfully navigated the procedural complexities of restoring the company to the Companies Register, enabling the claim to proceed. Kelly then progressed the claim through to a successful conclusion, securing compensation for the client’s injuries.
