Public ignorant of new claims procedure

With road traffic accidents expected to rise in zero temperatures

As temperatures take a nosedive serving as a bitter reminder that winter has arrived we can take it as read that road traffic accidents will be on the increase.

But what you probably don’t know is that there’s a new procedure for claims under £10,000 which is designed to speed things up and reduce costs.

Good news, says Kent personal injury lawyer Neille Ryan but he’s convinced that many people are ignorant of the changes.

Neille, who specialises in road traffic accident claims at leading regional law firm Furley Page, says: “You can use the new scheme if the accident was on or after April 30 this year and the damages for your injuries are likely to be at least £1,000.

“The £10,000 ceiling includes travel expenses, medication costs, treatment and lost earnings but excludes vehicle damage and hire costs.”

The new procedure is divided into three phases:

  • Phase 1: submission of completed claim notification form online. The other driver’s insurers then have 15 working days (30 if the other driver is uninsured). If the deadline passes the claim may have to be heard in court.
  • Phase 2: acquisition of medical report on your injuries, after which you have 15 days to complete a settlement pack with details of your injuries and financial losses. This is submitted to the other side with a proposed settlement figure. They have 15 days to accept or make a counter-offer. If agreement isn’t reached the claim moves to phase three
  • Phase 3: the papers are sent to court so a judge can decide on the amount of compensation you should receive. You may not have to attend the hearing.
