You may be getting others to act on your behalf to sell your products or services.
You would want to be clear what obligations the respective parties have, what authority an agent may have and how such an arrangement can be brought to an end. We recommend that you reflect this in a written agreement.
There can be advantages particularly as regards pricing in an agency relationship. The major disadvantage is that where goods are being sold and an agent has authority to enter into contracts on your behalf, it is likely that the Commercial Agents (Council Directive) Regulations 1993 (as amended) will apply.
This means that compensation may be payable to the agent on termination of the agreement and commercially needs to be budgeted for.
