Protocols, disputed wills and ACTAPS
Today, no matter what context your legal dispute falls under, Courts will try to encourage the parties to exchange information and to explore settlement options rather than issuing Court proceedings. This means that where a dispute arises, the parties are expected to negotiate before issuing Court proceedings.
The Association of Contentious Trusts and Probate Specialists (ACTAPS) has prepared a Protocol setting out the appropriate procedure to be followed before taking their dispute to the Courts.
