Partnership disputes

Disputes can arise within partnerships that can often be complex and require an understanding of the underlying rights and duties between partners.

The position will depend upon whether the partnership is unlimited and governed by the Partnership Act 1890 or a more recently permitted Limited Liability Partnership. The answer may be affected by the terms of any written agreement governing the partnership.

Managing partnership disputes

Issues relating to partnerships which are commonly referred to us include:

  • Disputes between partners about performance and profit share
  • The expulsion, or intended expulsion of a partner
  • Disputes arising in the course of dissolution and winding up of a partnership

We will discuss with you the objectives and how best to achieve this in the context of the type of partnership and business.

At Furley Page, we act for a range of partnership types including farming partnerships and professional partnerships such as solicitors, accountants, doctors, dentists, veterinary practices, architects, surveyors and engineers.

We can advise you on partners’ rights and remedies with a view to finding a practical solution to differences which may have arisen within the partnership.
