New Rules On HIPs Mean More Headaches For Homeowners

The controversial HIPs – home information packs – have reared their heads again, thanks to new regulations that come into force on April 6. From then on they will have to be completed before a property can be marketed as opposed to just ordered.

As this will have an impact on the majority of residential properties put on the open market for sale, home owners should commission a HIP as soon as they decide to sell, says Kent property lawyer Myfanwy McDonagh.

Myfanwy, head of residential property at leading regional law firm Furley Page, comments: “This is important as it will move the whole procedure forward more quickly. The other thing to watch out for is that HIPs must now include a ‘property information questionnaire’ (PIQ). This is a detailed form which asks for specific details from the seller so many people will find professional assistance in completing it a real help.” 

The preparation of a HIP can take anything up to a fortnight, depending on how quickly searches are returned by local authorities. When ordered through a solicitor, a HIP is the property of the seller who can instruct any estate agent of their choice to handle the sale.
